Protecting your personal data
Our philosophy and our undertakings
HAROPA PORT undertakes to safeguard your personal data and to provide a high level of protection for such information compliant with the EU’s General Data Protection Regulation (GDPR) and French law 78-17 on Data Processing, Data Files and Individual Liberties. In that connection, you will find below a statement of our policy for the protection of your personal data in the context of your use of the “HAROPA PORT Real Estate” website. Our policy is notably aimed at specifying the types of personal data likely to be collected by our website and the manner in which the information is collected, processed and stored, in addition to your rights. Your Data Controller
“Grand port Fluvio-Maritime de l’Axe Seine”, otherwise known as “HAROPA PORT”, is the Data Controller for your personal information. As such it will be referred to below as “Grand port Fluvio-Maritime de l’Axe Seine” or alternatively as “HAROPA PORT”, or “We”. Your personal data and collection of that data by HAROPA PORT. The personal data provided to us by you entirely of your own volition may be collected in connection with the following:
- Your visits to our Website,
- Specific requests,
- Creation of a user account.
Collection of certain categories of data may be mandatory or optional. If applicable, mandatory information will be notified to you. Our policy is to refrain from any transfer of your data outside the European Union. If in exceptional circumstances we do make such a transfer, this can only be to destination countries or organisations covered by an adequacy decision (cf. GDPR Article 45) or sufficient appropriate safeguards (cf. GDPR Article 45).
The processing of your personal data:
We process your personal data by entering it in databases. They are stored, retained and, if applicable, rectified, erased, archived or anonymised in accordance with the procedures described below. We need to process your personal data for the following main purposes:
1 ) Responding to your requests for information on the conditions for setting up business operations.
We use your personal data to respond to your requests for information. Your data allows us to interact with you in order to define your needs precisely. Your personal data are also necessary for the functioning of a “HAROPA PORT Real Estate” website member account (e.g. saving an offer basket, creating automated notifications).
2 ) Improving the use of our services and our offers.
We process your personal data in order to ensure optimum use of our services and to improve our commercial offering. Where applicable, we can track your user pathway and conduct satisfaction, opinion and statistical surveys on an anonymous basis. We also perform statistical monitoring of your interests via the “Favorites” and “Alert” functions. Your personal data is not transmitted to third parties and its use remains strictly internal.
The founding principles of our processing of your personal data:
In accordance with regulations, our processing of your personal data is carried out in complete compliance with legislation and essentially in the following circumstances:
- where you agree to the processing of your personal data based on your express, freely given and explicit consent and for legitimate purposes. You may withdraw that consent at any time by contacting the delegated Data Protection Officer (DPO); or,
- where that processing is justified by the requirements of performance of the contract signed by you with HAROPA PORT; or,
- where the processing of your personal data is necessary for the pursuit of our legitimate interests, always on the assumption that such interests are proportionate and protective of your fundamental rights and privacy; or,
- where legislation or regulations in force require us to process and/or archive your personal data.
Manner and duration of retention of your personal data:
We handle your personal data in accordance with the following procedures:
- An “active phase” in which your data are retained for the time required by their processing, our customer relationship or, where applicable, contractual performance.
- An “archive phase”: this begins at the end of the “active phase” where justified on legitimate grounds, your personal data being archived subject to restricted access and for a limited duration.
- A “deletion or anonymisation phase”: this begins on completion of the preceding two phases; your personal data are deleted or anonymised in a manner that ensures that they cease to be personal and able to identify you. As an example, we provide below the data retention durations applicable to the following processing categories (subject however to regulations requiring differentiated retention periods):

Accessibility and communication of your personal data:
Your personal data can be accessed only by individuals needing such access in order to carry out authorised processing. Depending on your needs, the degree of maturity of your project and subject to your consent, HAROPA PORT may need to communicate your personal data to partners and organisations in order to determine the conditions for implementation of your project. Your data may also be communicated to our service providers for the purposes described in the present document. Service providers or partners potentially able to access your personal data may most notably be the following (this list is not exhaustive):
- Partners that may be involved in responding to your requests (e.g. local government, central government departments, economic development agencies) in order to determine the conditions for implementation of your project.
- Service providers assisting us in improving our services, conducting analyses of the data and optimising our offers, or carrying out opinion surveys and building statistics. We do not engage in any trading of your personal data.

We may also need to communicate your personal data to the French authorities, government departments or courts, notably in connection with litigation or legal formalities imposing such communication.
The security and confidentiality of your data
We undertake to store your data in a totally secure manner. To that end, we implement control procedures to prevent all risks of destruction, loss, disclosure or unauthorised access affecting your information. Exercising your rights with regard to your personal data
Subject to applicable legislation and certain restrictions or circumstances, you have the following rights:
- A right of access notably allowing you to obtain:
- Confirmation that data concerning you are (or are not) being processed.
- Communication of a copy of all data concerning you held by the Data Controller.
- A right to request the portability of certain data, allowing you to obtain your personal data in a structured, commonly used and machine-readable format.
- A right to reject our use of your personal data.
- A right to rectify, amend and update your data.
- A right of erasure or limitation of the processing of your personal data.

Amendment of the personal data protection policy
